This website is operated by ACG Wines Limited, trading as Clos Ostler. References to “Clos Ostler”, “we”, “us” and “our” refer to ACG Wines Limited and, where applicable, the licensed entity through which alcohol is sold.

These terms apply to your use of this website and every order placed through it. By using the website or placing an order, you agree to these terms.

AGE RESTRICTIONS

You must be 18 years of age or over to enter this website or purchase alcohol from Clos Ostler.

If an order is being delivered to another person, the recipient must also be 18 years of age or over.

Customers are required to declare their age when entering the website and again before completing an alcohol purchase. We may refuse or cancel an order where age cannot be adequately verified.

ORDERS

All orders are subject to product availability, payment authorisation and compliance with applicable alcohol licensing requirements.

We may decline or cancel an order where:

• a product is unavailable
• an incorrect price or description has been published
• payment cannot be authorised
• we reasonably suspect fraud or unauthorised use
• fulfilling the order would breach applicable law or an alcohol-licence condition

If we cancel an order after payment has been taken, the amount paid will be refunded promptly.

PRODUCTS AND VINTAGES

Clos Ostler wines are produced in limited quantities and availability may change without notice.

Bottle and packaging images are illustrative. Minor variations may occur between production runs. Where a particular vintage is ordered, we will not substitute another vintage without your consent.

Reviews, scores and drinking windows are provided for general information. Individual bottles may develop differently according to storage and handling.

PRICES AND PAYMENT

Unless stated otherwise, all prices are in New Zealand dollars and include Goods and Services Tax.

Delivery charges, where applicable, are displayed before payment. Discounts and promotional offers are subject to their stated conditions and cannot be exchanged for cash.

You confirm that you are authorised to use the payment method selected at checkout.

DELIVERY

New Zealand delivery is NZ$15 for orders under NZ$300 and included for orders of NZ$300 or more.

Orders are governed by our Shipping Policy. You are responsible for providing a complete and accurate physical delivery address and ensuring that a person aged 18 or over is available to receive the order. Adult signature is required and identification may be requested.

RETURNS AND REFUNDS

Damaged, incorrect and faulty orders are governed by our Return and Refund Policy.

COLLECTION 001

Collection 001 is a fixed 24-bottle purchase. Payment and delivery timing are governed by the schedule selected when the Collection is reserved.

Collection 001 concludes after the selected payment schedule has been completed and does not renew automatically. The Collection composition, total price, payment schedule, delivery schedule and Collector privileges displayed when the Collection is reserved form part of the purchase terms.

PRIVACY

Our collection and use of personal information is governed by our Privacy Policy.

INTELLECTUAL PROPERTY

Unless otherwise stated, all website content, including photographs, text, trademarks, graphics and design elements, belongs to Clos Ostler or is used with permission.

Content may not be reproduced, distributed or used commercially without prior written permission.

LIABILITY

To the extent permitted by law, Clos Ostler is not responsible for losses caused by misuse of the website, incorrect information supplied by a customer, improper storage after delivery, or events outside our reasonable control.

Nothing in these terms excludes or limits any right, guarantee or liability that cannot lawfully be excluded.

CHANGES TO THESE TERMS

We may update these terms to reflect changes to our products, services, operating practices or legal obligations. The version published when an order is placed applies to that order.

GOVERNING LAW

These terms are governed by New Zealand law. Any dispute will be subject to the jurisdiction of the New Zealand courts.
